If you or a loved one were diagnosed with cancer after exposure to Roundup weed killer, you may be entitled to file a lawsuit.
Roundup weed killer products, manufactured and marketed by Monsanto (now Bayer) have been implicated in hundreds of cancer injury claims. Studies have found that the weed killer contains glyphosate, a chemical that is associated with increased risk of cancer, including Non-Hodgkin’s lymphoma and cutaneous T-cell lymphoma.
Several lawsuits have been filed and courts are concluding that Monsanto compromised the safety of its customers by failing to warn them about Roundup risk and marketing the product as safe. In three of these Roundup cancer lawsuits, juries have awarded plaintiffs hundreds of millions of dollars for their Roundup-related injuries.
At Nguyen & Associates, our attorneys have been investigating the situation surrounding Monsanto and its product, Roundup. We are currently accepting claims from people that have received a cancer diagnosis after exposure to the weed killer.
If you or a loved one received a non-Hodgkin’s lymphoma or any other circulatory cancer diagnosis following Roundup exposure, you may be eligible to file a lawsuit. Call us today to schedule a free case evaluation with one of our Roundup cancer attorneys.
Roundup is one of the most popular products of Monsanto, an agrochemical company purchased by Bayer in 2018. The glyphosate-based herbicide is generally used in homes, farms and gardens around the US as a weed killer.
Monsanto has produced several formulations of Roundup, marketed under different brand names including:
However, glyphosate is also very toxic for humans and other mammals. It can cause a range of symptoms upon exposure, including:
Non-Hodgkin’s lymphoma is a type of blood cancer that occurs in a person’s lymphocytes and weakens the body’s ability to fight diseases. These lymphocytes are part of the vascular system, which carries blood, oxygen and nutrients around the body.
The Mayo Clinic explains that non-Hodgkin’s lymphoma can be fatal and the symptoms of this cancer usually include:
The severity of this cancer often depends on its stage of development. Stage I and II are quite troublesome and will include cancerous cells affecting one or two lymph node regions or one organ as well. When the cancer progresses to Stage III or IV, it gets more serious and may affect several organs and tissues.
There are several subtypes of non-Hodgkin’s lymphoma, and they can include the following:
Increasing studies are indicating that Monsanto’s glyphosate-based Roundup may be responsible for cancer diagnosis in several users of the product. The International Agency for Research on Cancer has classified glyphosate as “probably carcinogenic”. Although the Environmental Protection Agency concluded that glyphosate does not cause cancer, other studies indicate differently.
The Journal of Mutation Research indicates that high exposure to glyphosate, such as daily use of Roundup, increases the likelihood of a cancer diagnosis by 41%.
The question though is: after 45 years of being in the market and billions of dollars in sales, why is Roundup only being linked to cancer now? The answer lies in evidence from internal Monsanto emails, reports, text messages and testimonies that show the company was hiding evidence that would have implicated its product.
One study published in the International Journal of Risk for Safety in Medicine concluded that “[i]f the company had confidence in the safety of its products, there would be no need for such behavior, but it is obvious that there are problems that Monsanto needs to conceal.”
Commenting on this conduct, the court in re Roundup Prod. Liabl. Littig., No. 16-MD-02741-VC, 2019 WL 1084170, at *3 (N.D. Cal. Mar. 7, 2019) held that “… there is strong evidence from which a jury could conclude that Monsanto does not particularly care whether its product is in fact giving cancer…”
Due to this alleged deceit and the company’s refusal to take responsibility for the possible defects in its products, hundreds of claims have now been filed to secure justice for customers who have been injured as a result.
If you have been exposed to Roundup, either directly or indirectly, and received a cancer diagnosis as a result, you may have a claim.
You may have been at risk through direct exposure if you spent time spraying Roundup without adequate protection to your body. Inadvertent contact with the skin through splatter and the mist from spray may be absorbed through the skin, mouth, nose and eyes.
If you have spent a lot of time either working in your garden using this product or in the course of your job as a farmer or gardener, you may have had chronic low-dose or high-dose short term exposure.
Many people experience indirect exposure to glyphosate on a daily basis. The Journal of the American Medical Association reports that the traces of Roundup in humans has increased by more than 500% in the last two decades. If Roundup is being used around you, there may be indirect exposure through the soil, ground water, air, rain or food.
With sufficient levels of exposure, Roundup weed killer may be dangerous to you and may have caused your cancer diagnosis. If you suspect that you are now suffering non-Hodgkin’s lymphatic cancer or other circulatory cancer because you used Roundup, you may have a claim for damages.
